I filed for my EAD last year along with 485 and the lawyer sent the application to Nebraska Service Center, however, the receipt notice I received was from Texas Service Center.
Now, for Q11 - Have you ever applied for EAD from USCIS? Which USCIS office, which office should I mention? NSC or TSC?

This was a complete and total screw up on my part (I forgot my flash was on) but after looking at it for a while....I kind of like it. Somehow, it works (to me anyway)...I should inform you that a few people I've shown this to from school think I'm either crazy or possibly going blind because I like it.

Hello ,
My company file my H1B 3 years back , (from F1-H1), now i have to extend my H1B1 , and my company HR is having a doubt about the fees involeved .
I am sure i have to pay
190 $ - H1 Fees
500 $ - DHS fees
i am not sure if i need to pay 750$ or 1500$ Data collection fees , please suggest .
I 129 application says " if same company filing for , second extension of stay , this fees need not be payed " please advise

Hi,
I got a RFE on my 485 to submit all the W-2 and 1040. I do not have one of my W-2 form which my previous employer never provided me.
I want to write a covering letter regarding non availability of that W2. I have email proofs of my requests to the employer regarding the W2. I also want to attach a copy of the letter which IRS has sent me regarding the complaint I have filed regarding the same.
Could any of you guys help me with a format of the letter and also what all I need to include in that letter. I also need to know to whom should this letter be addressed.

I have recently applied for my wife's EAD to Phoneix Lock box and got the Receipt from NSC with the LIN number. RD: 02/25/11 and ND:02/28/11. Check also got cashed. I tried to access that receipt number in USCIS case status website online to get the status yesterday 03/09/11; it says the case number is not found. I am sure I typed the correct receipt number. Any idea what could be wrong? Has anyone experienced this before? Should I contact the customer service? Please help me.

it's catch-22 situation. its easy to get 797, but not VISA, entry to US and most importantly a job in this economy. same as housing, cheap prices, but no job security. not to state the obvious but, there is a reason why cap didn't reach in a day.
a good idea though is, apply for H1, get 797 approved. Normally its for 3 years from Oct'09. But don't go for stamping for another year(not sure if u can wait on stamping) or the period legally allowed and don't try to come to US for another six months or the period legally allowed . So u can come to US in 2011, if its allowed legally. does any one know the law?

For my marriage, I applied for her appointment at the consulate on L2. The date was set such that we would have our marriage certificate by then. When she went for the interview, she showed them the marriage certificate, and got the L2 approved.
If she is planning to change her name, then it gets complicated as she can only fix an appointment at the consulate after updating her name, passport, marriage certificate etc etc etc

You did not mention if you already filed your AOS application. If yes, then you may keep your application going if it's been more than 180 days since you filed.
If you have not filed I-485 then your new employer will have to start the process from beginning. You may be able to retain the old PD even if previous employer revoked the I-140, unless USCIS revoked your I-140 for fraud.

Hi,
I-485 filed in july 2007. I-140 cleared in 2005.
We filed for GC in 2003 (eb3) in spite of my husband having two advanced degrees (M.Tech and Ph.d) but he is not working in the same field of ph.d. His company randomly filed in eb3 for all the employees.
But now my husband is diagnosed with chronic disease. We are thinking if we switch to eb2 since he is eligible to do that, atleast he would get some medical benefits for the treatment.
How do we proceed with this? Do we have to file labor again?
Any suggestions would be really appreciated.

Hello Everyone,
I have a question related to my H1b. I used to work for employer A till Feb 2, 2007(Friday) and then moved on to employer B. I started on a project for employer B on Feb 12, 2007(Next Monday). At that time it was decided that my start date for Employer B would be Feb 5, 2007 to maintain the continuity in the job experience, although the project start date was Feb 12.
Now I have moved on from Employer B to C and employer B is saying that they can provide an experience letter showing start date as Feb 12th only because thats how they had it setup at that time.
This effectively means that I had no job for a week Feb 5-10. I am sure that employer A didnt canceled my H1b so I dont think I was out of status, but can this "out of job" status affect my GC or any other immigration related processing in future?
As you would notice, this is my first post so please excuse me if a similiar question was asked earlier. Any responses would be greatly appreciated.

Here's my situation. I have an approved I-140 (EB2), my I-485 has been pending for more than an year. Due to recent lay-offs, I will have to change my employer through an H-1B transfer. My wife was on H-4. However, just this year she got an H-1B approval with consular processing since when we applied for her H-1b this year, she was not in US.
Now 2 weeks back, her employer applied for her COS through regular processing. I assume this takes about 3-4 months.
My question is - now that I am doing my H-1B transfer to another employer, do I have to worry about my wife's H-4 extension as well, or just leave that as it is, as her application for COS to H-1B is pending with USCIS.

To me, it means that they will issue an RFE to ask you about the new (self-employed) job and description of your job duties in the new job, compensation etc. And they should match with original LC.
I have a personal belief that this is a complicated thing in itself and depends largely on the job title, job descriptions and your qualifications mentioned on LC. It would be a good idea to discuss the specifics with a competent attorney before taking any step that might lead you to a new greencard from scratch. Good Luck.

Congratulations - you have 90 days after it expires to renew it. Since you got your GC within 60 days, there is nothing to worry about. You must however talk to your HR with a copy of ur GC and update the I-9. But that is just for records and should there be an audit, you should be all set.
