Because you still need a visa to enter the USA (though you have an H-1B approval) and application for the visa abroad is not always easy.
But if your visa is stamped and not expired, do you still need an AP ?

I send my Employment based I-485/I-765/I-131 application on June 29th 2007 and received at NSC on July 2nd 2007 (USPS Express mail tracking no. XXXX). It�s more than 100 days and I didn�t even received the Receipt Number for all the applications.
I have following question for CIS Ombudsman�s office:
1) Per US Law, I have to get the EAD in 90 days of filling of my application? How I can get the EAD in 90 days where I didn�t even get the Receipt Number after 100 days?
2) Why �First In First Out (FIFO)� process is not followed by USCIS for receipting? It�s unfair to applicant like me when application filed on August 17th 2007 enjoying the EAD card and able to work.
3) What action you can will take to force USCIS follow their own operational manual guidelines and follow FIFO in future?

There are laws and there are exceptions. Basically there are no Laws when it comes to Immigration. USCIS/DOS can do whatever they like.
Look at Jul'2007, people with EB3 PD of 2004 got approved and people with 2001 are still waiting.
Look at EB2 approvals these days. People with 2006 PD are getting approved and people with 2004 PD are still waiting.
Can somebody explain how PD in each VB goes backward? Is it possible to get new applications with older PD in between? Don't they have computers with all the data where they can see how many applications are pending?
Howcome they were giving unused numbers to EB3 till last year and how come they changed the interpretation this year. The rule didn't change, they simply changed their interpretation of it.
If EB3 would have known about this new interpretation then they would have never applied in EB3 category.
Bottomline is there are no rules. USCIS/DOS is doing whatever they like and playing with our life. Nobody knows how many applications are pending. Nobody can predict the VB movement, it goes forward and backward. We cann't plan our lives and live in limbo all the time.

I got an email from TSC mentioning that my file had been requested for review and to allow 60 days.
Also, I got a letter from USCIS (TSC) in response to the SR that my file was being actively worked on.
Is that the same as an officer reviewing the case? or that comes next after file has been requested.
Did you receive any email response from the Service center processing your case, after you raised an SR ?
If in that response..they mentioned that an officer is reviewing your case..then you should be safe..

Thats the right way. Probably I should not have told him that I have AP in my hands. This is what my attorney said. But now I have no idea if my h1 will be extended or not once I have used the AP.

That is true. USCIS will send you finger print notice when kids turn 14. They will print all the fingers (code3, I guess) at this time.
